Victim Offender Mediation or Restorative Justice Approach Restorative justice is an approach to justice that focuses on the needs of victims and offenders, instead of the need to satisfy the abstract principles of law or the need of the community to exact punishment. That is to DO SOMETHING TO THE OFFENDER, it is recognised that doing something WITH THE OFFENDER has a far reaching effect on the satisfaction of the victim, and the re-offending rate of the offender. Many offenders have no idea of the effect that their actions are having on their victims, and the concept of victim can be far reaching and not just mean the person who has been harmed. The victim’s family may be victims and if the offender is imprisoned the offender’s family also become victims of the crime; when a loved one is incarcerated and income and support of that person is lost, not to mention the shame and humiliation of the family. Victims are given an active role in a dispute and offenders are encouraged to take and face responsibility for their actions, "to repair the harm they've done- by apologising, returning stolen money, or (for example) doing community service". Restorative Approaches can be used in a wide variety of settings
The Ministry of Justice indicates that restorative justice reduced the frequency of reconviction by 27% and more than half of victims wanted to participate in restorative justice. 85% of victims were satisfied with their experience of restorative justice, and victims taking part benefit from increased emotional well-being, reduced stress and a faster return to work. Lord Woolf said "Skilled mediators are now able to achieve results satisfactory to both parties in many cases which are quite beyond the powers of the lawyers and the courts to achieve". |
